1 - INTRODUCTION
1.4. As explained below, all the transactions for flight tickets via the WEBSITE are carried out by Enuygun.com which is an A class TÜRSAB (Association of Turkish Travel Agencies) agency, or by Akdeniz Petur Turizm Seyahat Tic. Ltd. Şti.; and all insurance policy purchase transactions are carried out by Enuygun SigortaAcenteliği Limited Şirketi.
1.5. The owner of the WEBSITE reserves the right to additionally charge for the content and service it provides and/or gain profits from the tools such as commission, advertising sponsorship of the WEBSITE.
2 - DESCRIPTIONS
2.1. WEBSITE: means the website where various services and content that are provided in the framework identified by Enuygun.com and which is available online;
2.2. USER: means the real persons or legal entities online accessing to the WEBSITE;
2.3. LINK: means the links given to the other web sites, files, content from the WEBSITE or given from another web site to the WEBSITE;
2.4. CONTENT: means any information, file, picture, number, price or similar visual, written or audial images published by the WEBSITE and/or other web site or available to access.
3 - GENERAL PROVISIONS
3.1. Enuygun.com, always checks the accuracy and currency of the current information on the WEBSITE given by Enuygun.com. But despite our reasonable efforts, the information given on the WEBSITE might not be current and actual. It is not implicitly or explicitly guaranteed or undertaken that the currency, accuracy, conditions, quality, performance, saleability, availability for a cause of the information on the WEBSITE and the effects on other information, service or products related or irrelevant to such information including but not limited to that on the WEBSITE or their completeness. Therefore, Enuygun.com is completely free to determine which services or CONTENT opened to the access within the WEBSITE will be charged.
3.2. The persons benefit from the services given by Enuygun.com or use the WEBSITE can transact on the WEBSITE only personal/corporate objects and in accordance with the law. The USERS shall be responsible for all the legal and criminal liabilities related to the any transaction or actions they made on the WEBSITE. Each USER agrees, declares and undertakes that he shall not do anything that can be constituted as encroach on Enuygun.com's and/or any other third party's rights; disclose written, visual or audial information, and he consents any personal written, visual and audial information he gives to the Enuygun.com can be used, processed, kept, announced and disclosed and shared with Enuygun.com's partner insurance, flight, hotel service providers and other service providers when Enuygun.com discloses such information to the said partners and the user shall be responsible any probable damages that may arise from Enuygun.com's disclosure of said information. The USER agrees and undertakes that he shall not copy, reproduce, distribute, process the pictures, texts, visual and audial images, video clips, files, data bases, catalogs and lists within the WEBSITE and shall not compere with Enuygun.com neither by doing such activities or other direct and/or indirect ways.
3.3. Enuygun.com, its collaborative persons, the employees and managers of Enuygun.com and authorized dealers of Enuygun.com shall not be responsible for the services provided and content given by any third parties within the WEBSITE. The accuracy and guarantees of compliance with laws of information, content and visual images provided and published by any third parties are completely under the responsibility of such parties carrying out these activities. Enuygun.com does not undertake and guarantee the accuracy and/or compliance with the laws of the services and CONTENT provided by the third parties. Unless Enuygun.com explicitly indicated that the service subject to the comparison is given by itself, the USER agrees and undertakes that the services given by Enuygun.com are only comparison services, there is no agency service given between the USERS and the service providers for any reasons whatsoever and Enuygun.com is not a party for the disputes that may arise.
3.4. The USERS agree and declare that the information and the content provided by the USERS within the WEBSITE are true and legal. Enuygun.com has no obligation and liability to search the truth of the information sent to the Enuygun.com, uploaded or changed provided by the USERS; undertake and guarantee that such information and content are safe, true and legal.
3.5. The USERS agree and undertake that they shall not perform any activities that can cause unfair competition in accordance with the provisions of Turkish Code of Commerce within the WEBSITE and that can harm the personal and commercial activities and reputation of Enuygun.com or the third parties.
3.6. Enuygun.com reserves the right to change the services and CONTENT provided within the WEBSITE at any time. Enuygun.com can use this right without any notification or giving any time. The USERS must ensure that any content, information, material and data they share on this WEBSITE are true and complete. The WEBSITE is not responsible for any loss including but not limited to the losses arising from false or incomplete information of the USERS. If the WEBSITE detects that this content, information, material or data is not true or complete, it can request change and/or correction of them. The user shall meet such requests immediately. Change and/or correction requests made by Enuygun.com can be made by Enuygun.com directly if required. Losses, legal and criminal liabilities which arise or can arise from the USERS not performing the change and/or correction requests of Enuygun.com, belong to the USERS completely.
3.7. LINKS can be given by Enuygun.com to other web sites which are not under the control of Enuygun.com and which are owned and administered by other third parties and/or CONTENT and/or files via the WEBSITE. These LINKS are provided only due to frequency easiness and do not constitute any declaration or guarantee about the website or information it contains or support the relevant website or the operator. Enuygun.com has no liability for websites, files and CONTENT reached through the LINKS on the WEBSITE and services or products or their CONTENT provided from the websites accessed through these LINKS.
3.9. According to Article 20 of the Regulation on Distance Agreements which entered into force within the framework of the 6502 numbered Turkish Law on Consumer Protection, Enuygun.com is a company mediating for a distance agreement for seller or provider by using means of distance communication or making them used within the frame of the system it created. Sellers and providers are directly responsible to consumer in providing insurance, transportation, accommodation services and needed information according to the Regulation on Distance Agreements. Enuygun.com is responsible for only keeping the conducted transactions for 3 years and giving that information to the relevant institution, organization and consumers if requested.
4 - TRAVEL SPECIFIC CONDITIONS
4.2. Payment; Online ticket purchasing procedures on the internet can be made only with Visa and Master Card credit cards and with the procedure as follows:
You will be asked to enter the three-digit security code (CVC number) of your credit card during the purchase process for due to security reasons. The security code is composed of three digits coming after the credit card number on the signature section on the reverse side of the behind your credit card. When you approve a purchase, the relevant amount (including tax and other costs) is collected from the credit card used for the payment.
The payment system known as 3D secure is obligatory in all shopping actions USERS do on the WEBSITE. You can obtain the needed information about 3D secure usage from your bank.
4.3. Cancel / Return: For tickets you purchased on Enuygun.com, rules on cancellation, return and changes of the airline company you transacted with shall be effective. These rules can vary depending on the airline company concerned. You can get information from the airline companies about these rules. All and any service costs of the ticket you bought shall not be paid under any circumstance. Also, fined return or refusal of the return of the ticket can occur in accordance with the rules of the airline company. Procedures you will make on the internet must be made exactly in accordance with the instructions on internet pages. Enuygun.com is not responsible for any fault which can arise from you doing the procedure wrongly and in an accurate way, entering or choosing inaccurate information including but not limited to name, communication information, flight date, flight time and flight class in the online ticket buying procedure with reservation, reservation change, cancellation and returns. Reservations made cannot be transferred to another person and the name cannot be changed.
4.4. USERS are held responsible in the case of incomplete visa or passport related issues, or failure to complete the visa process required by the country the passenger will be traveling to. Enuygun.com is not responsible for reminding the passenger to complete these requirements. Enuygun.com is not responsible if a USERS departure is obstructed because of such issues, or for personal reasons originating from the passenger (such as tax debts, or lack of transit visas). Therefore USERS must accept full responsibility for and undertake any cancelations or delays that can occur as a result of such issues.
4.5. Enuygun.com shows successful sale situation in the flight ticket transaction in its web site and mobile app at the latest stage of the sale flow. Additionally, it sends an e-mail to the registered e-mail address and an SMS to the mobile phone of the traveler to inform him/her of the successful sale. The results page which is showed to the USERS in the purchase stage is required and sufficient for the fact that the ticket sale has been conducted. E-mail and Mobile phone SMS is a free service of Enuygun. Enuygun is not responsible for any access failure of delay in these services in any way.
4.6. Terms on Hotel Comparison: Enuygun.com publishes the hotel information it obtains through contracted travel and hotel search websites. The correctness and currency of the hotel information such as reservation status, room prices, etc. are provided by the relevant websites and Enuygun.com does not guarantee the correctness and currency of such information. Room reservations made after the hotel comparison procedure on Enuygun.com and payments/pricing and other procedures of such reservations are contracted between the travel and/or hotel search website and the USERS. Rules, policies, concepts, service standards, pricing types of the additional prices of the hotels which will be stayed in can be different from the statements. Enuygun.com is only a publisher and takes no responsibility for any procedure which will occur after the person is redirected from Enuygun.com or in probable disagreements between the travel and/or hotel search website and the USERS, in case of any failure or lack of the service they provide and the USERS acknowledges that Enuygun.com cannot be deemed responsible and acts in accordance with that fact. In the event that the accommodation service is purchased, the USERS are expected to follow the laws and visa rules of the country in which they will stay and the general rules, reservation terms and policies of the hotel in which they will stay. Enuygun.com can redirect the USERS to such third. Party websites such as Booking.com and Otel.com after providing the hotel comparison service and it also provides services which enable the USERS to pay for the hotel reservations on the WEBSITE in hotels providing their services such as Expedia Affiliate Network (EAN). In such cases, the service procedure is solely between the USER and the relevant hotel provider, collection is made by EAN and Enuygun.com has no liability regarding these services.
4.7. LogiConnect®: To provide better service and more and low-priced services to the Users, aside from the linked (connecting) flights offered by airline companies, Wingie can link the flights of two or more airline companies that are not connected to each other and can offer them to the User as a more affordable or shorter travel option. This flight option, including the connecting flight type called "LogiConnect”, may require separate check-ins for each connecting flight, picking up the baggage if any, returning it again on the next flight, passing through the security and passport controls again if necessary, having a transit visa or a valid visa and being accepted to a flight from a different airport than the one where landed. The User needs to make sure that they have sufficient time to connect flights for the tickets they purchase via LogiConnect, that they need to pick up their baggage and deliver it back for the next flight, that they need to pass through the security and passport controls and be sure of the visa requirements of the country they are connecting flights to and take the necessary precautions. Wingie does not accept any responsibility on these issues.
4.8. On flights booked with LogiConnect, even if the User has taken all precautions, since flights are separately booked from two or more different airlines without a common ticket agreement, the damages that the User may incur, due to not being able to catch the next flight because the previous flight is delayed, the flight plans are changed or the flight is canceled, can be covered by Wingie under certain conditions. In this case, Wingie may provide an alternative flight to the User free of charge or for a certain fee or may make a partial refund for the other flights that could not be used. In addition, for the guarantees to be offered by Wingie within the scope of LogiConnect for a possible delay (such as adverse weather conditions), there must be no visa or transit visa problems in the country to be connected to, the baggage must be picked up during the connecting and the next flight must be checked-in, and the security and passport control points must be reached in time. If the delay or cancellation occurs due to unavoidable extraordinary circumstances such as adverse weather conditions, strike, bankruptcy of the airline company or unexpected events at airports (airplane crash, terrorist attack, taking measures or temporarily closing the authorized institutions), Wingie does not provide any guarantee within the framework of LogiConnect. For the LogiConnect guarantee to be provided by Wingie, the User must inform Wingie on the issue in a timely and accurate manner as detailed below.
4.8.1 More than 48 hours to the flight
a) If a delay / cancellation notice regarding the previous flight / flights was received by the User, the User must inform Wingie about the issue without losing any time over the call center telephone numbers by using the relevant section in the Contact form or by using the online chat service. If the User does not inform Wingie in a timely manner by using one of these methods, the User loses all rights to the guarantees provided by Wingie within the framework of LogiConnect.
b) Wingie may provide alternative flight options to the User by contacting the User through the registered telephone number. If the User does not accept alternative options or if Wingie does not offer an alternative option, the full prices of the flights following the delayed / canceled flight are returned to the User, and the tickets of those flights are canceled.
4.8.2 Less than 48 hours to the flight
a) If a delay / cancellation notice regarding the previous flight / flights was received by the User, the User must inform Wingie about the issue without losing any time over the call center telephone numbers or by using the online chat service. If the User does not inform Wingie in a timely manner by using one of these methods, the User loses all rights to the guarantees provided by Wingie within the framework of LogiConnect.
b) Wingie may offer alternative flight options to the User by contacting the User through the registered telephone number. If the User does not accept alternative options or if Wingie does not offer an alternative option, the full prices of the flights following the delayed / canceled flight are returned to the User, and the tickets of those flights are canceled. Very rarely, if the User has to act quickly and fails to contact Wingie in the meantime, the User can buy the required ticket for transportation and then request a refund from Wingie. However, Wingie should be notified as soon as possible on the reason of this transaction and with the information of the delay and / or cancellation of the previous flight, and the originals of the flight tickets and invoices must be sent to Wingie authorities. In any case, Wingie officials will assess this situation and decide whether or not to make a refund or decide on the amount of the refund. The refund to be done shall exceed 50% of the amount of the missed flight in TL, in no event.
4.9 LogiConnect Special Services:
4.9.1 Accommodation: If, as mentioned in article 4.17, the User misses the next flight due to a last-minute delay in the previous flight (a delay not known beforehand) and remains at the airport, but the first available flight agreed upon during the contact with Wingie (i) is after 12 am and (ii) if the User has to wait for more than 8 hours, the cost of a hotel room where the user will spend the night may be partially or completely covered by Wingie. The costs to be covered shall in no case exceed 50% of the amount of the missed flights. For this, the User is obliged to submit the required invoices to Wingie within 10 days after the travel. Otherwise, Wingie will not accept any responsibility.
4.9.2 Meal: If the User has to wait for more than 4 hours at the airport for the new flight organized by Wingie, the costs of meals not exceeding the amount of 30 TL per person or the equivalent of that in foreign currency shall be covered by Wingie. For this, the User is obliged to submit the required invoices to Wingie within 14 days after the travel. Otherwise, Wingie will not accept any responsibility.
4.10 LogiConnect Validity: The guarantees offered by Wingie related to LogiConnect are subject to the following rules.
4.10.1 The relevant flight tickets must have been purchased on Wingie. If a change is made to the ticket of any flight directly from the respective airline after the purchase and without the approval of Wingie, all guarantees provided by Wingie related to LogiConnect will be terminated. The User cannot claim any rights from Wingie within the framework of LogiConnect even if there is a problem in the flights.
4.10.2 If the user later makes a change in the contact information provided during the ticket purchase, all guarantees offered by Wingie related to LogiConnect will be terminated. The User cannot claim any rights from Wingie within the framework of LogiConnect even if there is a problem in the flights.
4.10.3 If the User buys additional services for the respective flights after the flight purchase is complete (such as the baggage purchase), all guarantees offered by Wingie related to LogiConnect will be terminated. The User cannot claim any rights from Wingie within the framework of LogiConnect even if there is a problem in the flights.
4.10.4 The condition for the guarantees provided by Wingie related to the problems in the LogiConnect process is that the delay or cancellation of the previous flight takes place within the standard course of air transport. If the delay or cancellation occurs due to unavoidable extraordinary circumstances such as adverse weather conditions, strike, bankruptcy of the airline company or unexpected events at airports (airplane crash, terrorist attack, taking measures or temporarily closing the authorized institutions), Wingie will no longer have the liability to provide any guarantee within the framework of LogiConnect. Wingie will, to help the User and without any guarantee, give as much case-based support to each user as possible.
4.10.5 LogiConnect is only valid for flights indicated with the LogiConnect phrase on the WEBSITE. The connecting flights of airlines and one-way flights with a single PNR are not covered by the LogiConnect guarantee by Wingie. The relevant airlines offer their own guarantees for these flights.
